Tesoro Si operates an online store and is registered as: Oblaka Sp. z.o.o with its headquarters located in Wrocław (50-033), Poland, at ul. Józefa Piłsudskiego 50. It is registered in the Register of Entrepreneurs by the VI Economic Department of the National Court Register of the District Court for Wrocław-Fabryczna under the KRS number: 000096705. The company's Tax Identification Number (NIP) is 8992923136, and it is also registered under the REGON number 521772860, or Tesoro Si is commonly referred to as the seller.
Glossary of terms:
BOK - Customer Service Office available by phone at the number provided on the main page of the Tesoro Si online store tesorosi.pl and through the contact form on the internet at tesorosi.pl.
Working Day - one day from Monday to Friday, excluding public holidays.
Order Form - a form available in the online store that allows the Customer to place an order to purchase a Product.
Customer - an individual, legal person, or unincorporated organizational unit with legal capacity who uses the Tesoro Si online store, including making purchases.
Consultant - a person representing the interests of the seller, an employee of the seller with the necessary functions to perform their duties.
Consumer - a Customer who is a natural person using the Tesoro Si online store, including making purchases, for purposes unrelated to their business or professional activity (in accordance with art. 22 1 of the Act of April 23, 1964 - Civil Code).
Customer Account - a set of resources in the Seller's IT system where information about the Customer, including address information and order history, is stored.
Cart - a functionality of the Tesoro Si online store that allows the Customer to view selected products for purchase and enter or modify order details such as the number of products, delivery address, invoice data, delivery method, and payment method.
Materials - all content posted by the Customer on the Tesoro Si online store, including photos, forum posts, product reviews from the Tesoro Si online store's assortment.
Payment Service Provider - an external entity to Tesoro Si that intermediates in the payment process through bank transfer, credit card payment, or electronic payment system like PayPal.
Tesoro Si Online Store - an online store operated by Tesoro Si, accessible at the internet domain tesorosi.pl.
Specification - customer guidelines based on which the ordered product is created, including the type and color of fabrics used to create the product and the dimensions of the person for whom the product is created.
Product Page - a page on the Tesoro Si online store that provides information about a product.
Service - electronic services provided by the Seller through the online store.
Sales Agreement - a distance contract concluded between the Customer and the Seller through the online store, the subject of which is the purchase of a Product.
Order - the Customer's declaration of intent submitted to the Seller and directly aimed at concluding a Sales Agreement for a Product with the Seller.
§1. GENERAL PROVISIONS
1. This regulation defines:
・ the conditions for placing orders for products offered by Tesoro Si and available in the Tesoro Si online store tesorosi.com, delivering ordered products to the Customer, and the Customer's payment for such products;
・ the Customer's rights to cancel an order and withdraw from the contract;
・ the rules for submitting and processing complaints.
2. To browse the websites of the Tesoro Si Online Store, including viewing the assortment offered by the Tesoro Si Online Store, it is necessary to have an end device. This means a device with access to the Internet and a web browser. These can be browsers such as Internet Explorer, Microsoft Edge, Google Chrome, Mozilla Firefox, Opera, or Safari in their current versions. Additionally, for using some functionalities (e.g., scheduling appointments or placing orders for products) of the Tesoro Si Online Store, an active email account (e-mail) is also necessary.
3. As part of using the Tesoro Si Online Store, customers are prohibited from providing unlawful content that violates the law or good manners. Customers are also obligated to refrain from any activity that could negatively affect the proper functioning of the Tesoro Si Online Store. This includes any interference with the content of the Tesoro Si Online Store or its technical elements.
Furthermore, the use of the Tesoro Si Online Store for purposes contrary to its intended use is prohibited. This includes sending spam, conducting any commercial, advertising, or promotional activities on the websites of the Tesoro Si Online Store.
4. Browsing the assortment of the Tesoro Si Online Store does not require registration. Customers can place orders for products available in the assortment of the Tesoro Si Online Store after providing the necessary personal and address data that enable order fulfillment.
5. The Seller complies with the principles of personal data protection of Customers provided for in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
6. The Customer consents to the collection, storage, and processing of their personal data by the Seller for the purpose of order fulfillment. The detailed conditions for the collection, processing, and protection of personal data by the Seller are specified in the "Privacy Policy" of the online store.
7. All prices listed on the website of the online store are gross prices.
§2. PRODUCT INFORMATION
1. Information about products available in the assortment of the Tesoro Si Online Store tesorosi.pl constitutes an invitation to enter into an agreement within the meaning of Article 71 of the Civil Code.
2. Prices of products indicated on the websites of the Tesoro Si Online Store tesorosi.pl:
・ include VAT and are presented in EURO;
・ include the cost of delivery from the seller to the buyer, selected by the seller (the choice of courier company remains at the discretion of the seller). Otherwise, the customer is required to pay an additional delivery fee;
・ the total cost of the order (i.e., the price of products along with delivery costs) will be indicated during the order confirmation through a conversation with a consultant.
3. Tesoro Si reserves the right to make changes in the prices of Products available in the online store, introduce new Products, as well as carry out and cancel promotional campaigns or make changes to ongoing promotions. The right referred to in the previous sentence does not affect orders placed before the effective date of the price change.
4. Tesoro Si may conduct promotional campaigns and sales on separately defined terms. In the case of promotional campaigns involving a temporary reduction in the price of a Product, the Seller on the Product page indicates, next to the promotional price, the previous lowest price of the product that was valid in the 30 days prior to the introduction of the promotion. The extent of the reduction will be determined in relation to the lowest indicated price.
§3. CONDITIONS FOR PLACING AND FULFILLING ORDERS
1. The Customer can place orders for products available in the assortment of the Tesoro Si Online Store tesorosi.pl 7 (seven) days a week and 24 (twenty-four) hours a day, subject to prohibitions or trade restrictions resulting from mandatory legal regulations.
2. All products sold in the Tesoro Si online store tesorosi.pl are custom-made according to the Specification provided by the customer. The Specification is necessary for the proper execution of the product. Before fulfilling each order, the online store will agree with the Customer on the details of the specification.
3. Placing an order by the Customer means submitting an offer by Tesoro Si to conclude a sales (purchase) agreement for the ordered product. The offer is binding for the Customer if Tesoro Si immediately confirms its receipt.
4. After placing an order, a confirmation of receipt of the order placed by the Customer will be sent to the email address specified by the Customer in the order process.
5. To fulfill the order for tailor-made products, Tesoro Si will contact the ordering party to establish the Specification. To create the specification, a Specification form will be sent to the customer's email address provided during registration or order placement, along with instructions on how to complete it:
・ in order to complete the form correctly, the Customer has the right to seek advice and assistance from the Customer Service Office (BOK).
・ the online store tesorosi.pl is not responsible for incorrect measurements and completion of the Specification form by the Customer.
・ after completing the Specification form, the Customer will submit the form in person, by mail, or via email to the email address of the Online Store.
6. If the Customer completes, agrees on, and submits the Specification form to the Online Store, and the fulfillment of the order itself is possible without reservations, an email confirmation of the order acceptance for fulfillment will be sent to the Customer's email address. The confirmation of order acceptance is a statement by Tesoro Si of accepting the offer referred to in paragraph 6 above. Tesoro Si has 7 days to confirm the acceptance of the Customer's order (counting from the day of confirmation of receipt of the order by the entity). In the event that Tesoro Si does not confirm the acceptance of the order for fulfillment within the aforementioned period, an agreement between the Customer and Tesoro Si regarding that order is not concluded. Any payments made for the unaccepted order will be promptly refunded to the Customer in accordance with the provisions of § 13 of this Regulation.
7. In the event of the impossibility of fulfilling the Customer's order for other reasons, including if the purchase of the products from Tesoro Si's suppliers will not be possible within the time specified for order fulfillment, Tesoro Si will inform the Customer about the situation by sending a message to the email address provided by the Customer or by providing information by telephone to the number provided by the Customer, within the period resulting from the universally applicable legal regulations. In such a case, the order is canceled.
The cancellation of an order for reasons indicated in this paragraph may occur no later than by the end of the order fulfillment period. And if this period has not been determined, within 30 days from the date of its acceptance for fulfillment by Tesoro Si.
8. In the event that the fulfillment of part of the order is not possible for the reasons indicated in the preceding paragraph, Tesoro Si may propose to the Customer:
・ cancellation of the entire order (if this option is chosen by the Customer, Tesoro Si will be released from the obligation to fulfill the order);
・ cancellation of the order in part, where fulfillment is not possible within the specified period. If this option is chosen by the Customer, the order will be fulfilled in part, with Tesoro Si being released from the obligation to fulfill it in the remaining scope;
・ division of the order and setting a new fulfillment date for the part of the order that cannot be fulfilled in the originally specified timeframe. If this option is chosen by the Customer, the products comprising the order will be sent in several separate shipments, and the Customer will not incur additional costs related to the division of the order into multiple shipments.
9. In the event that the Customer does not choose any of the order fulfillment methods in the situation described in paragraph 8 above (including cases where it is not possible to contact the Customer for reasons beyond Tesoro Si's control), Tesoro Si will deliver the products for which the order can be fulfilled within the specified timeframe. In the remaining scope, the order will be canceled, and the Customer will be notified at the email address provided by the Customer during the order placement process.
The partial cancellation of the order, as mentioned in the preceding sentence, may occur no later than by the end of the order fulfillment period. And if this period has not been determined, within 30 days from the date of its acceptance for fulfillment by Tesoro Si.
10. In the event that the Customer chooses to make payment for the order in advance, Tesoro Si is entitled to cancel the order if the Customer fails to make full payment within 7 days from the date of receiving the order confirmation for fulfillment. The cancellation of the order means that Tesoro Si is released from the obligation to fulfill it.
11. In the event of the cancellation of an order in the situations indicated in paragraphs 8, 10, and 11 above, if payment for the ordered item has been made (in whole or in part), Tesoro Si will refund the amount paid by the Customer in accordance with applicable legal regulations. The rules for refunding payments are described in detail in § 13 of this Regulation.
12. The Customer is obliged to provide the correct (current) and accurate address to which the ordered item is to be delivered (in the case of orders with delivery), and to promptly collect the ordered item. Tesoro Si is not responsible for non-delivery or delayed delivery of the ordered item (delivery after the established delivery date) in the event of the Customer providing an incorrect or inaccurate address.
13. In cases where the Customer could not collect their order from the courier company and the order is returned to the supplier, the subsequent delivery is carried out at the sole expense of the ordering party.
§4. ORDER MODIFICATIONS
1. The customer may make changes to the order or cancel the order until the moment when the order is accepted for processing. In such a case, if payment has been made, a refund will be made in accordance with applicable law. The rules for refunding payments are described in detail in paragraph 13 of this regulation..
2. The customer has up to 5 calendar days to make any changes to the order or cancel it. After 5 calendar days, the order may be passed for production, and from that moment, the customer loses the right to a refund. The customer has the right to a refund for the order only until the moment when the order is passed for production.
3. The customer can make changes to the delivery address (excluding the option of delivery to Tesoro Si) or change the invoice details until the order is shipped, by providing the appropriate instructions to the Customer Service Department (BOK).
4. Changes to the order in the above-mentioned scope (delivery address, changes to invoice details) can be made by the customer in person, by phone, or via email. In the case of changes made through the Customer Service Department (BOK), the customer will receive confirmation of the changes to the email address provided in this specification form.
5. In the event of the customer's cancellation of the order in the situation described in point 1 above, the customer will receive confirmation of the order cancellation to the email address provided in this specification form.
§5. PAYMENT METHODS AND COMMENCEMENT OF ORDER EXECUTION
1. Orders placed in the Tesoro Si online store (tesorosi.pl) must be paid in advance (before the receipt of the order).
2. The customer cannot make a partial payment for part of the order in advance and the remaining part upon receipt.
3. Detailed information about available payment methods is provided during the order placement process.
4. Advance payments can be made via bank transfer or one of the electronic payment systems accepted by Tesoro Si.
5. The execution of the order will commence upon receipt by Tesoro Si of full payment or, in the case of payments processed by the payment processing entity, upon confirmation by such entity of the successful completion of full paymen.
6. The customer has 5 working days to make payment for their order. After this period, if payment is not received in the seller's bank account, the purchase agreement will be unilaterally terminated. The customer will be notified of this at the email address provided in this specification form.
7. The seller enables payment for ordered products in the form of prepayment:
a) through the Przelewy24 electronic payment system operated by PayPro S.A., ul. Kanclerska 15, 60-327 Poznań, in accordance with the system's regulations (https://www.przelewy24.pl/regulamin);
b) through electronic payment via the PayPal system, which is administered by PayPal (Europe) S.a.r.l. et Cie, S.C.A.;
c) by electronic transfer, using BLIK or a debit/credit card (list of supported cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro) through an electronic payment system operated by Blue Media S.A. with its registered office in Sopot, ul. Powstańców Warszawy 6, in accordance with the operator's system regulations;
d) by traditional bank transfer to a bank account.
§6. ORDER EXECUTION
1. Tesoro Si provides information on the number of business days (i.e., Monday to Friday, excluding public holidays) within which the shipment with the ordered item will be dispatched on the Tesoro Si website tesorosi.pl. The mentioned information refers to the time counted from the acceptance of the order for execution to the moment of sending the ordered item to the Customer via Poczta Polska (Polish Post) or a courier company. The order execution time is provided taking into account the time required to assemble all ordered products. The order execution time depends on the availability of the specific product.
2.The ordered item is delivered to the address provided by the Customer through Poczta Polska (Polish Post) or a courier company.
3. In connection with the order execution, communication regarding the current progress of placing and executing the order (order status) is sent to the Customer's email address. As part of this communication, Tesoro Si may send information about an incomplete order and, after the order has been fulfilled, Tesoro Si sends a thank you message with a request for the Customer to express their opinion (review) of the order. It is voluntary for the Customer to provide such an opinion (review).
4. The order execution time is up to 3 months, depending on the seasonality (the estimated time for making a specific dress can be established with us via email). It is also necessary to consider the delivery time of the dress by the courier: within Poland - up to 2 business days, within the European Union from 2 to 10 calendar days, to other countries from 5 to 20 calendar days.
5. The Seller processes orders in the order they are received.
6. Upon receiving the shipment, the Customer should carefully check the condition of the packaging and its contents. In the event of any damage or other irregularities, the Customer should prepare a damage report in the presence of the courier and notify the Seller.
7. In the event of the refusal to accept the shipment or the inability to deliver it due to reasons attributable to the Customer, the Seller has the right to charge the Customer for the costs incurred in connection with such a situation (e.g., the costs of returning the shipment to the Seller or re-sending it to the Customer).
§7. WARRANTY AND COMPLAINTS UNDER THE WARRANTY
1. Tesoro Si is responsible towards the Customer if the sold product has a physical or legal defect (warranty). A physical defect occurs when the sold product does not conform to the contract or the Customer's Specification. Tesoro Si is liable under the warranty. Any provisions in this §10 do not exclude or limit the rights of Customers who acquire products as Consumers, as provided by applicable law, including in particular Articles 556-576 of the Civil Code..
2. Tesoro Si will respond to the Customer's complaint under the warranty within 14 (fourteen) calendar days and notify the Customer of the further proceedings.
3. A complaint under the warranty should include the data of the person or entity submitting the complaint (first name and last name or full name, contact details), the reason for the complaint, and the content of the request. As a result of considering the complaint under the warranty by Tesoro Si, the Customer should provide the claimed product or products along with proof of purchase of this product (or products) to Tesoro Si and describe the complaint as specified below:
・ In the case where the product was delivered through Poczta Polska (Polish Post) or a courier company, the warranty claim (i.e., the claimed product, proof of purchase, and description of the complaint) should be sent to the address of the Tesoro Si online store tesorosi.pl (we recommend sending it via Poczta Polska registered letter or economy package).
4. In the event of a complaint being upheld in favor of the Customer, Tesoro Si will promptly replace the defective product with one free from defects or rectify the defect. If it is not possible to exchange the product, rectify the defect, or reduce the price, Tesoro Si will refund the payment immediately, in accordance with applicable law.
5. Customers who purchase products for purposes directly related to their professional or business activity (Customers who are not Consumers) have the right to submit a complaint in accordance with the applicable provisions of law. In this case, Tesoro Si's liability under the warranty for physical defects of products is limited to the Customer's right to demand the removal of defects. In such a case, Tesoro Si, at its discretion, will promptly replace the defective product with one free from defects or rectify the defect. Tesoro Si may also withdraw from the contract and refund the price paid for the product affected by the physical defect to such a Customer who is not a Consumer.
6. In all other cases, Tesoro Si's liability under the warranty for product defects in relation to Customers who are not Consumers is excluded. Subject to the mandatory provisions of the law, Tesoro Si's liability for damages caused to Customers who are not Consumers is limited to the amount that such a Customer paid to Tesoro Si for the purchase of the respective product.
7. Only the person who placed the order in the tesorosi.pl online store can file a complaint. Complaints from third parties are not accepted unless required by law.
8. The Customer cannot withdraw from the contract if the defect is immaterial.
9. The Customer cannot withdraw from the contract if the non-conformity of the Product with the contract is immaterial.
10. If necessary to assess physical defects of the Product, it should be delivered to the address: Tesoro Si! Wrocław 50-033, ul. Józefa Piłsudskiego 50.
§8. WARRANTY TERMS
1. Tesoro Si sells products that are covered by a warranty for a period of 12 months. The warranty (if applicable to the sold product) does not exclude, limit, or suspend the buyer's rights arising from the provisions on the warranty for defects in the sold item. For more information about the warranty, please contact Customer Service.
2. In the case of a product for which the manufacturer, distributor, or other guarantor has provided a warranty, the Customer can file a complaint about a product with defects:
・ by using the rights arising from the provided warranty;
・ by using the rights available to them in relation to the seller under the warranty - in such a case, a complaint should be submitted in accordance with the provisions of §10 of this regulation.
§9. CANCELLATION OF THE ORDER AND WITHDRAWAL FROM THE CONTRACT
1. The ordering party has the right to cancel the order before its processing, after agreeing to the Specification, within 5 calendar days from making the payment by contacting Customer Service;
2. Tesoro Si sells products that are made to individual order according to the Customer's Specification. Once the order is accepted for processing (after agreeing to the Specification), the Consumer cannot withdraw from the contract for the sale of a product purchased on the tesorosi.pl Internet Store.
3. The right to withdraw from the contract does not apply to the Consumer in relation to a contract (in accordance with Article 38 of the Act of May 30, 2014, on consumer rights) for the provision of services if the entrepreneur has fully performed the service with the clear consent of the consumer, who was informed before the provision began that after the performance of the service by the entrepreneur, the consumer will lose the right to withdraw from the contract;
4. The Consumer who wants to exercise the right to withdraw from the contract should inform Tesoro Si of their decision to withdraw from the contract by means of an unequivocal statement (e.g., a letter sent by post, fax, or email). The Consumer can use the statutory withdrawal form template, which is Attachment No. 2 to the Act of May 30, 2014, on consumer rights. The use of the above templates is not mandatory. To meet the withdrawal deadline, it is sufficient for the Consumer to send information regarding the exercise of the right to withdraw from the contract before the withdrawal period expires.
5. The right to withdraw from the contract does not apply to the Customer in relation to contracts specified in Article 38 of the Act of May 30, 2014, on consumer rights, including in relation to contracts:
a) for the supply of goods made to the consumer's specifications or clearly personalized,
b) for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons, if they were unsealed after delivery.
§10. REFUND OF PAYMENTS TO CUSTOMERS
1. Tesoro Si will refund the payment without undue delay, but no later than within 14 days in the following cases:
・ cancellation of the order or part of the order (in this case, the corresponding part of the pre-paid price is refunded) paid in advance before its execution;
・ acceptance of a complaint and the impossibility of exchanging the product, repairing the product's defect, or reducing the price;
・ we do not accept the Customer's offer regarding the order if the order was paid in advance.
2. In the event of withdrawal from the contract in accordance with §12 of this regulation, Tesoro Si shall refund the Consumer without undue delay, no later than within 14 days from the day of receiving the Consumer's declaration of withdrawal from the contract.
3. Tesoro Si will make the refund using the same payment method that the Customer used unless the Customer has expressly agreed to a different refund method that does not involve any costs for them.
4. If the Customer's order was paid using a specific payment method (e.g., by credit card and bank transfer), the refund will be made proportionally and using the same methods used for payment.
5. In the broadest extent permitted by law, Tesoro Si is not liable for the lack of refund or delays in the refund, even if Tesoro Si has exercised due diligence, including sending requests to the Customer's provided email address to provide their bank account number. 6. In the event that the return of products (withdrawal from the contract) or the submission of a complaint takes place at Tesoro Si's Salon, and the order was pre-paid, the refund will be made in accordance with the rules described in paragraphs 3-4 above.
7. Only the amount that has been credited to the seller's bank account is subject to a refund. All commissions or additional fees should be covered by the ordering party or deducted from the refund amount (e.g., bank fees, currency exchange fees, and others).
8. The product should be delivered to the Seller at the address: Maria Owczarek, ul. Strażacka 81a, 43-382 Bielsko-Biała.
9. The Customer is obliged to properly secure the Product during transportation. The Seller does not accept shipments sent with cash on delivery.
10. In the event of withdrawal from the contract, the consumer is responsible for any decrease in the value of the item resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the item.
§11. DANE OSOBOWE
1. Personal data provided by Customers on the tesorosi.pl online store (during the account registration process, when placing an order without registration on the tesorosi.pl online store, and during the use of the tesorosi.pl online store, including making purchases) are processed by Tesoro Si with its registered office in Wrocław (50-032), ul. Józefa Piłsudskiego 50 (data controller).
2. Providing personal data by the Customer is voluntary but necessary for making purchases and using electronic services provided by Tesoro Si that require the provision of personal data. Tesoro Si processes personal data for the purpose of providing electronic services, concluding agreements with the Customer, and executing sales agreements for products ordered by the Customer on the tesorosi.pl online store. In case the Customer consents, as mentioned in §16 of this regulation, Tesoro Si also processes personal data for the purpose of providing the newsletter service.
3. The Customer has the right to access their personal data, correct them, and request their deletion. Personal data can be corrected or deleted by contacting BOK.
4. The Customer's provision of personal data in their public profile, as mentioned in §3(2) of this regulation, implies consent to share these data with an unlimited number of people.
5. By providing their data, the Customer declares that the provided personal data are their own, and they are solely responsible for providing accurate data.
6. Detailed provisions regarding the protection of the Customer's personal data can be found on the tesorosi.pl online store's website dedicated to the privacy policy.
7. The Seller is not responsible for the Customer entering incorrect data (especially by providing incorrect data in the forms available on the website) or for the Customer's actions that hinder or prevent the provision and execution of services by the Seller.
§12. COMPLAINTS
1. Subject to the provisions of §10 of this regulation, all complaints, including complaints regarding the operation of the tesorosi.pl online store or electronic services, can be reported to Tesoro Si:
・ in writing to the registered office address of Tesoro Si (with the recommended note "Complaint," although this note is not mandatory),
・ via email to the address: wrozka@tesorosi.pl (with the recommended subject of the message: "Complaint," although the above subject is not mandatory),
・ through BOK (Customer Service).
2. The complaint should include the details of the person or entity submitting the complaint (name or full name, precise address or email address), as well as an explanation of the reason for the complaint and the content of the request.
3. Tesoro Si will review complaints based on this regulation and the provisions of the law generally applicable in the Republic of Poland.
4. A response to the complaint will be provided in a manner corresponding to the method of submitting the complaint, i.e., by registered mail to the address provided in the complaint or by email to the email address provided in the complaint or from which the complaint was sent, within 30 days from the date of receiving the complaint, unless this regulation (§10(2) - complaints regarding warranty) or an absolute provision of the law specifies a shorter deadline for responding to the complaint.
5. The Customer's use of the complaint procedure is voluntary.
§13. FINAL PROVISIONS
1. Unless required by applicable law, Tesoro Si does not use alternative methods for handling complaints and pursuing claims. This includes not using alternative dispute resolution mechanisms for consumer disputes.
2. A consumer may seek free assistance regarding their rights and disputes between them and Tesoro Si by contacting the district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., Federation of Consumers, Polish Consumers' Association). Information for consumers, including information on obtaining assistance, is also available on the website of the President of the Office of Competition and Consumer Protection (uokik.gov.pl).
3. Any disputes arising between a Customer who is not a Consumer and Tesoro Si will be resolved by the court with jurisdiction over the registered office of Tesoro Si.
4. Tesoro Si makes every effort to ensure that the services provided through the tesorosi.pl online store are of the highest quality. However, Tesoro Si does not exclude the possibility of temporarily suspending the availability of the tesorosi.pl online store when necessary for maintenance, inspection, equipment replacement, modernization, or expansion of the tesorosi.pl online store. Tesoro Si will make every effort to ensure that any suspension of access to the tesorosi.pl online store occurs during nighttime hours.
5. Individual settings of the end device may result in differences between the product visualization on the Customer's computer and the actual appearance of the product (color, proportions, etc.). A Consumer is entitled to withdraw from the contract in accordance with the provisions of §12 of this regulation.
6. This regulation is subject to the provisions of the law generally applicable in the Republic of Poland.
7. Product names provided on the tesorosi.pl online store website are used for identification purposes, and these names may be protected and reserved under the provisions of the Industrial Property Law of June 30, 2000, or other legal regulations..
8. For statistical purposes and to ensure the highest quality of services, Tesoro Si uses information stored by the server on the Customer's end device, which is then read each time the web browser is connected (so-called cookies). The Customer can specify the conditions for storing or accessing cookies using the settings of their web browser. The Customer can change the browser settings so that it does not accept such files or informs about their transmission.
However, it should be noted that not accepting cookies may make it difficult to use the tesorosi.pl online store. The Customer's use of a browser that allows the storage of cookies on their end device implies consent to the storage of such files on that device. More information in this regard can be found in the privacy policy.
9. The language of contracts concluded with Tesoro Si is Polish or English.
10. Tesoro Si reserves the right to change this regulation for important reasons, including:
・ the need to adjust the regulation to the legal provisions directly affecting this regulation, requiring modification to ensure compliance with the law;
・ the need to adjust the regulation to the recommendations, orders, judgments, decisions, interpretations, guidelines, or decisions of competent public authorities;
・ expansion or modification of the functionality of the tesorosi.pl online store, including the introduction of new electronic services or changes to existing functionalities of the tesorosi.pl online store;
・ changes in the technical conditions for the provision of electronic services;
・ the need to eliminate ambiguities, errors, or typographical errors that may occur in the regulation;
・ changes in contact details, names, identification numbers, email addresses, or links provided in the regulation;
・ prevention of abuse;
・ improving customer service;
・ changes in the process of concluding contracts through the tesorosi.pl online store
11. If Tesoro Si changes the regulation, the company will make it available on the tesorosi.pl online store. Tesoro Si will inform about the change in the regulation through a message on the tesorosi.pl online store and by sending registered Customers a notification of the change to the email address associated with their account.
12. In other matters not regulated by the provisions of this Regulation, the relevant provisions of Polish law apply. If the provisions that apply in the consumer's country are more favorable for them and cannot be excluded by agreement, they will apply to contracts concluded through the online store.
13. The regulation amended by Tesoro Si is the primary and binding regulation for registered Customers. The Customer will not terminate the agreement to operate an account in the tesorosi.pl online store or renounce the account on the terms specified in §2 of this regulation. Before the date of publication and entry into force of the amended regulation. The effective date of the amended regulation will be at least 7 days from the date of notification of the change in the regulation made in accordance with paragraph 11 above.
14. Any changes to the regulation will not affect orders placed before such changes, which will be fulfilled on the previous terms.
§14. INTELLECTUAL PROPERTY
1. All content posted on the online store (including graphics, texts, page layout, and logos) that does not originate from the Customer or other suppliers is protected by copyright and is the exclusive property of the Seller. Use of this content without the written consent of the Seller may result in civil and criminal liability.
2. The Customer is obliged to use all content available on the online store only for personal use. The use of content for other purposes is allowed only if explicitly indicated by the Seller.
3. The use of the online store, including the use of textual materials, graphics, photos, applications, databases, or other content, does not imply the acquisition of any rights by the Customer in relation to the specified content, and in particular does not imply the acquisition of copyright, related rights, or licenses.
4. The following actions are prohibited without the explicit consent of the Seller:
a) copying, modifying, and electronically transmitting or otherwise the online store or its parts, as well as individual content made available through it,
b) distributing in any way the content published on the online store,
c) downloading the contents of databases and their secondary use in whole or in part.
